Booking, Online booking and Website Terms and Conditions
1. Booking Terms and Conditions
Where you book a ticket for an event or screening at Derby QUAD you agree that the following conditions shall apply to your booking:
a. The information on this Website is correct at the time of submission to the Website. It is your responsibility to ascertain whether an event or screening has been cancelled or rescheduled. We will make all reasonable attempts to promptly notify purchasers of any such cancellation or rescheduled event but make no guarantees in this respect.
b. We reserve the right to ask for proof of status for concessionary tickets at any time.
c. Only holders of tickets purchased from our Box Office, or our official ticket agencies, will be admitted to an event or screening.
d. You must not purchase tickets except for personal use and you represent and warrant that tickets are not purchased as part of any form of a for-profit business or commercial activity unless we have expressly authorised otherwise in writing.
e. We reserve the right to make adjustments and alter programmes, special offers and incentive rates at any time without notice.
f. You consent to the filming and sound recording of your participation in any event, as a member of the audience. QUAD is covered by 24 hour CCTV monitoring and we will endeavor to inform you prior to the commencement of the event if other filming or recording is to take place.
g. All mobile phones and pagers must be turned off before entering the auditoria.
h. Photography and recording by you of any kind is strictly prohibited during events, without our prior written consent.
i. You are not permitted to bring cameras and/or recording equipment of any kind into the cinema. It is a serious criminal offence to copy or attempt to copy any film or other copyright material exhibited in any part of the cinema, punishable on conviction with an unlimited fine and imprisonment of up to a maximum of ten years.
j. It is your responsibility to check your tickets when you book as mistakes cannot always be rectified.
k. It is your responsibility to check any age restrictions relevant to any events or screenings advertised by Derby QUAD.
l. Save in respect of liability which cannot be limited by law, our liability to you pursuant to these booking conditions is limited to the face value of the ticket purchased.
m. All tickets purchased are non refundable. Any request for a refund must be made in writing to QUAD customer services at the address below.
n. Derby QUAD is a fully accessible building and as such is not required by law to issue complimentary tickets in respect of ability or access without valid concession or discount.
o. Smoking is not permitted in any area of the premises.
2. Online Ticket Booking
a. Tickets for films and events at our cinemas are sold by us at the prices displayed for the relevant performance and the amount payable for them will be debited immediately from your credit or debit card. By requesting tickets through the Website you are placing a booking request for them on these Terms which are only accepted and binding on us once we have debited your card and sent you a confirmation booking reference which will be displayed on your screen and emailed to you.
b. In the case of tickets being offered for sale at the wrong price on-line (i.e. at a higher or lower price than is applicable at the box office) we reserve the right to insist that the tickets are refunded and the correct prices charged.
c. Once a booking is confirmed the ticket is non refundable. Any issues should be raised with Derby QUAD Customer Services.
d. You can collect your tickets from the Box Office at any time from when the booking is made until the start of the event or screening. You will need to bring either the card you paid with or a note of the booking reference to collect your tickets.
e. Concessionary and children’s tickets are offered for sale on the Website. In accordance with our General Terms you must bring proof of status or age with you to the cinema to collect the tickets and to gain admission to the event or screening.
f. Bookings made on the Website are encrypted for security. However, you acknowledge that the Internet is not entirely secure and whilst we will take reasonable steps to safeguard the security of any card information you impart, we shall not be liable for any damage you may suffer as a result of the loss of confidentiality of any such information.
g. You acknowledge that the cancellation rights contained in the Consumer Protection (Distance Selling) Regulations 2000 (as amended) do not apply to the services we offer.
h. Members must enter their details at the time of purchasing to claim any discount. It is not possible to amend the booking once it has been completed.
3. Refusal of Admission
a. We reserve the right to refuse any ticket holder admission to (and/or eject such person from) an event or screening, or to our building and auditoria.
4. Cancellations and Refunds
a. We regret that no refunds can be given under any circumstances, save where a ticketed event is cancelled or rescheduled.
b. Where screenings are cancelled we will endeavor to exchange tickets for a rescheduled screening where possible.
c. To avoid disturbing customers who arrive on time, customers arriving after the film has started will be admitted at an appropriate point. Refunds will not be issued in these circumstances.
d. We will attempt, where possible, to exchange tickets for another screening. This must be within three months of the date of exchange and the exchange must take place at least forty-eight hours prior to the start of a screening.
e. You acknowledge that the cancellation rights contained in the Consumer Protection (Distance Selling) Regulations 2000 (as amended) do not apply to the services we offer for advance sales of tickets.
5. Age Restrictions
a. Entry to films and events is restricted by the classification given by the British Board of Film Classification or others. We are required to refuse admission to anyone who is below the minimum age required by the relevant classification.
i. Anyone can be admitted to films classified as U or PG
ii. Children under 12 can be admitted to films classified as 12A but only if accompanied by an adult (i.e. someone over the age of 18).
iii. Nobody under the age of fifteen can be admitted to films classified as 15
iv. Nobody under the age of eighteen can be admitted to films classified as 18
b. Children under age 7 must be accompanied by a parent or guardian for all films starting at or after 7pm.
c. Children under 12 and under must be accompanied by a parent or guardian (aged 15 or over) at all times.
d. Babies under the age of 1 can go into screenings providing that:
i. they sit on a lap for the entire screening (i.e. do not take up a seat);
ii. they are removed from the auditorium should they cause disturbance to other customers; and
iii. the film is classified as U, PG or 12A.
e. Babies under the age of one will be admitted without charge. Tickets must be purchased for everyone else.
f. We reserve the right to require you to prove your age with appropriate photographic ID if you are going to a 12A, 15, 18 film or purchasing an alcoholic drink. If you are unable to prove your age you will be not be able to watch the film or buy an alcoholic drink. We reserve the right to ask for such proof at any time you are on our premises.
g. If you buy a ticket before we know its classification and you are not old enough to be admitted to the screening we will issue you with a full refund.
6. Food and Drink
a. Only food purchased at Derby QUAD may be consumed within the cinema.
b. Only alcohol purchased at Derby QUAD may be consumed in the building.
c. You must observe the licensing regulations at Derby QUAD concerning the sale and consumption of alcoholic drinks. In particular, you must not take untoughened glass into the auditorium.
7. Jurisdiction
These booking terms and conditions are governed by English law and subject to the non-exclusive jurisdiction of the courts of England and Wales.

By accessing and browsing the Website, or any part of it, you accept, without limitation or qualification, these Terms and Conditions and acknowledge that any other agreement between you and us is superseded and of no force or effect. Where you book a ticket on the Website, your purchase will be subject to our booking conditions.
Terms and Conditions of Use of the Website
1. We provide this Website for your personal entertainment, information and educational use only. It is subject to change by us without notice. You should assume that everything you see or read on the Website is subject to copyright or other intellectual property rights unless otherwise noted and may not be used except as provided in these Terms and Conditions or in the text on the Website without our prior written permission. We neither warrant nor represent that your use of materials displayed on the Website will not infringe rights of third parties not owned by or affiliated with us.
2. You may only download material displayed on the Website for non-commercial, personal use, provided you also reproduce all copyright and other proprietary notices contained on the material. You may not, however, distribute, modify, transmit, reuse, report, or use the contents of the Website for public or commercial purposes, including the text, images, audio and video without our prior written permission.
3. Images of people or places displayed on the Website are either our property or that of our licensors. 4. The trademarks, logos, and service marks (Trademarks) displayed on the Website, including the Derby QUAD logo are our registered and unregistered Trademarks or those of our licensors. Nothing contained on the Website should be construed as granting any license or right to use any Trademark displayed on the Website, without our permission or that of such third party that may own the Trademarks displayed on the Website. Your misuse of the Trademarks displayed on the Website, or any other content on the Website, except as provided in these Terms and Conditions, is strictly prohibited.

While we use all reasonable efforts to include accurate and up-to-date information or materials on the Website, we make no warranties, guarantees or representations as to its accuracy, timeliness, performance, completeness or suitability. We assume no liability or responsibility for any errors or omissions in the content on the Website. You acknowledge that such content may contain inaccuracies or errors and that we make no commitment to update such material. We expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law. 6. Whilst we endeavor to ensure that the Website is available 24 hours a day, we shall not be liable if for any reason the Website is unavailable for any time period. The formation, existence, construction, performance, validity in all aspects whatsoever of these Terms and Conditions or of any term of these Terms and Conditions or any dispute in relation to the materials contained in the Site shall be governed by English law. The courts of England and Wales shall have non-exclusive jurisdiction to settle any disputes which may arise out of or in connection with these Terms and Conditions or use of the Website. Your continued use of the Website indicates your acceptance of these Terms and Conditions.
