Booking Terms and Conditions

Where you book a ticket for an event or screening at Derby QUAD you agree that the following conditions shall apply to your booking:

  1. The information on this Website is correct at the time of submission to the Website. It is your responsibility to ascertain whether an event or screening has been cancelled or rescheduled. We will make all reasonable attempts to promptly notify purchasers of any such cancellation or rescheduled event but make no guarantees in this respect.
  2. We reserve the right to ask for proof of status for concessionary tickets at any time.
  3. Only holders of tickets purchased from our Box Office, or our official ticket agencies, will be admitted to an event or screening.
  4. You must not purchase tickets except for personal use and you represent and warrant that tickets are not purchased as part of any form of a for-profit business or commercial activity unless we have expressly authorised otherwise in writing.
  5. We reserve the right to make adjustments and alter programmes, special offers and incentive rates at any time without notice.
  6. You consent to the filming and sound recording of your participation in any event, as a member of the audience. QUAD is covered by 24 hour CCTV monitoring and we will endeavour to inform you prior to the commencement of the event if other filming or recording is to take place.
  7. All mobile phones and pagers must be turned off before entering the auditoria.
  8. Photography and recording by you of any kind is strictly prohibited during events, without our prior written consent.
  9. You are not permitted to bring cameras and/or recording equipment of any kind into the cinema. It is a serious criminal offence to copy or attempt to copy any film or other copyright material exhibited in any part of the cinema, punishable on conviction with an unlimited fine and imprisonment of up to a maximum of ten years.
  10. It is your responsibility to check your tickets when you book as mistakes cannot always be rectified.
  11. It is your responsibility to check any age restrictions relevant to any events or screenings advertised by Derby QUAD.
  12. Save in respect of liability which cannot be limited by law, our liability to you pursuant to these booking conditions is limited to the face value of the ticket purchased.
  13. All tickets purchased are non refundable. Any request for a refund must be made in writing to QUAD customer services at the address below.
  14. Derby QUAD is a fully accessible building and as such is not required by law to issue complimentary tickets in respect of ability or access without valid concession or discount.
  15. Smoking is not permitted in any area of the premises.

Online Ticket Booking

  1. Tickets for films and events at our cinemas are sold by us at the prices displayed for the relevant performance and the amount payable for them will be debited immediately from your credit or debit card. By requesting tickets through the Website you are placing a booking request for them on these Terms which are only accepted and binding on us once we have debited your card and sent you a confirmation booking reference which will be displayed on your screen and emailed to you.
  2. In the case of tickets being offered for sale at the wrong price on-line (i.e. at a higher or lower price than is applicable at the box office) we reserve the right to insist that the tickets are refunded and the correct prices charged.
  3. Once a booking is confirmed the ticket is non refundable. Any issues should be raised with Derby QUAD Customer Services.
  4. You can collect your tickets from the Box Office at any time from when the booking is made until the start of the event or screening. You will need to bring either the card you paid with or a note of the booking reference to collect your tickets.
  5. Concessionary and children’s tickets are offered for sale on the Website. In accordance with our General Terms you must bring proof of status or age with you to the cinema to collect the tickets and to gain admission to the event or screening.
  6. Bookings made on the Website are encrypted for security. However, you acknowledge that the Internet is not entirely secure and whilst we will take reasonable steps to safeguard the security of any card information you impart, we shall not be liable for any damage you may suffer as a result of the loss of confidentiality of any such information.
  7. You acknowledge that the cancellation rights contained in the Consumer Protection (Distance Selling) Regulations 2000 (as amended) do not apply to the services we offer.
  8. Members must enter their details at the time of purchasing to claim any discount. It is not possible to amend the booking once it has been completed.

Refusal of Admission

  1. We reserve the right to refuse any ticket holder admission to (and/or eject such person from) an event or screening, or to our building and auditoria.

Cancellations and Refunds

  1. We regret that no refunds can be given under any circumstances, including non-attendance due to Covid-19 restrictions, save where a ticketed event is cancelled or rescheduled by QUAD.
  2. Where screenings are cancelled we will endeavour to exchange tickets for a rescheduled screening where possible.
  3. To avoid disturbing customers who arrive on time, customers arriving after the film has started will be admitted at an appropriate point. Refunds will not be issued in these circumstances.
  4. We will attempt, where possible, to exchange tickets for another screening at the request of the customer. This must be within three months of the date of exchange and the exchange must take place at least forty-eight hours prior to the start of a screening.
  5. A fee of £1 per ticket will be charged for all transfers, payable on collection of the new tickets. Tickets can only be transferred once.
  6. Refunds/credits will not be issued for transfers to cheaper ticket rates. Payment will be required for the difference in price where transfers are made to a more expensive ticket price. This payment is in addition to the £1 transfer fee.
  7. You acknowledge that the cancellation rights contained in the Consumer Protection (Distance Selling) Regulations 2000 (as amended) do not apply to the services we offer for advance sales of tickets.

Cancellations and refunds specifically relating to Courses:

  1. Courses will run subject to reaching a required minimum uptake of seats to ensure sustainability.
  2. QUAD will contact you within a week prior to the course commencing regarding cancellation due to a low uptake or other reasons. In this instance, a full refund will be offered or a replacement transfer to another course may be offered if available.
  3. Refunds will not be available for cancellations due to bad weather outside of Derby City Centre or if QUAD as venue is still open.
  4. QUAD will contact students if a course is cancelled due to bad weather resulting in closure of the building or tutor being unable to travel and an alternative date will be offered.
  5. Students requesting a course refund for personal reasons, must provide no less than 10 working days notice before the course commences.
  6. Course refunds for personal reasons will be subject to a £25 admin fee.

Latecomers for Live and Encore Events

  1. Due to the layout and lighting levels in the auditorium during performances and in response to customer feedback, the following policy has been adopted for all Live and Encore Events.
  2. Latecomers may be seated by Usher or Duty Manager at a suitable break in the performance (to be determined by QUAD staff) within 10 minutes of the performance starting. If there is no suitable break in the performance, customers may be refused entry until the interval.
  3. Anyone arriving more than 10 minutes after the performance is programmed to start, and anyone leaving the auditorium during the performance, may be required to wait until the interval to return to their seat. This is both for their own safety and to avoid disruption to other customers within the auditorium.
  4. If there is no feasible entry point and no interval it may not be possible for us to allow entry to the screening at all.
  5. Refunds will not be issued to any customers who miss any section of the event as a result of action taken under this policy.

Age Restrictions

  1. Entry to films and events is restricted by the classification given by the British Board of Film Classification or others. We are required to refuse admission to anyone who is below the minimum age required by the relevant classification.
    1. Anyone can be admitted to films classified as U or PG
    2. Children under 12 can be admitted to films classified as 12A but only if accompanied by an adult (i.e. someone over the age of 18).
    3. Nobody under the age of fifteen can be admitted to films classified as 15
    4. Nobody under the age of eighteen can be admitted to films classified as 18
  2. Children under 12 and under must be accompanied by a parent or guardian (aged 15 or over) at all times.
  3. Babies under the age of one can go into screenings providing that:
    1. they sit on a lap for the entire screening (i.e. do not take up a seat);
    2. they are removed from the auditorium should they cause disturbance to other customers; and
    3. the film is classified as U, PG or 12A.
  4. Babies under the age of one will be admitted without charge. Tickets must be purchased for everyone else.
  5. We reserve the right to require you to prove your age with appropriate photographic ID if you are going to a 12A, 15, 18 film or purchasing an alcoholic drink. If you are unable to prove your age you will be not be able to watch the film or buy an alcoholic drink. We reserve the right to ask for such proof at any time you are on our premises.
  6. If you buy a ticket before we know its classification and you are not old enough to be admitted to the screening we will issue you with a full refund.

Food and Drink

  1. Only food purchased at Derby QUAD may be consumed within the building.
  2. Only alcohol purchased at Derby QUAD may be consumed in the building.
  3. You must observe the licensing regulations at Derby QUAD concerning the sale and consumption of alcoholic drinks. In particular, you must not take untoughened glass into the auditorium.

Jurisdiction

  1. These booking terms and conditions are governed by English law and subject to the non-exclusive jurisdiction of the courts of England and Wales.

Gift Voucher Terms & Conditions

  1. Gift voucher can only be redeemed against the product shown on the gift voucher.
  2. Gift vouchers will expire one year from the date of purchase. Gift vouchers which have expired will not be renewed or extended.
  3. Gift vouchers should be treated like cash. They cannot be replaced if lost or stolen.
  4. Gift Vouchers should be checked by the purchaser immediately upon receipt. Any discrepancies must immediately be brought to the attention of the receptionist who has issued the voucher. QUAD cannot be held responsible for discrepancies with a gift voucher once the sale is complete.
  5. Gift vouchers cannot be refunded or transferred.
  6. Gift Vouchers cannot currently be redeemed online.
  7. Gift vouchers have £0.0001 cash value and cannot be exchanged for cash.
  8. Gift vouchers will be issued at the full cost of the product displayed on the voucher. No cash change will be given on purchases.
  9. Gift Vouchers will be subject to verification at the time of presentation. QUAD reserves the right not to accept any vouchers that have or appear to have been forged, altered, damaged, defaced or otherwise tampered with.
  10. Gift vouchers will not be sold to customers or third parties who intend to re sell them at discount rates.
  11. Any personal data obtained from the purchaser of the gift voucher will be held and processed in accordance with relevant legislation. Personal data will not be passed to any other organisation unless it is necessary to do so to fulfil obligations. You have a right to request access to your personal data held by QUAD at any time by writing to us. You should inform QUAD of any inaccuracy in your personal data in order that it may be rectified. Personal data will only be taken for the purchaser of the gift voucher, not for the intended recipient.
  12. QUAD reserves the right to change the Terms and Conditions at any time.

Terms and Conditions for Summer Nights Film Festival

Booking Terms and Conditions

Summer Nights Film Festival is owned and managed by QUAD Ltd, Market Place, Derby, DE1 3AS.

All tickets purchased for Summer Nights Film Festival are directed through QUAD’s Box Office system and you are entering into a purchase agreement with QUAD Ltd.

When you book a ticket for an event or screening at Summer Nights Film Festival you agree that the following conditions shall apply to your booking:

  1. The information on this Website is correct at the time of submission to the Website. It is your responsibility to ascertain whether an event or screening has been cancelled or rescheduled. We will make all reasonable attempts to promptly notify purchasers of any such cancellation or rescheduled event but make no guarantees in this respect.

It is a serious criminal offence to copy or attempt to copy any film or other copyright material, punishable on conviction with an unlimited fine and imprisonment of up to a maximum of ten years.
  8. It is your responsibility to check your tickets when you book as mistakes cannot always be rectified.
  9. It is your responsibility to check any age restrictions relevant to any events or screenings advertised by Summer Nights Film Festival.
  10. Save in respect of liability which cannot be limited by law, our liability to you pursuant to these booking conditions is limited to the face value of the ticket purchased.
  11. All tickets purchased are non refundable except in the event of QUAD and Summer Nights Film Festival cancelling the event in it’s entirety.
  12. Smoking is not permitted in any area of the audience. Designated smoking areas may be provided at some venues
  13. Dogs are not permitted at any events unless they are assistance dogs.

Online Ticket Booking

  1. Tickets for films and events at Summer Nights Film Festival are sold by QUAD at the prices displayed for the relevant performance and the amount payable for them will be debited immediately from your credit or debit card. By requesting tickets through the Website you are placing a booking request for them on these Terms which are only accepted and binding on us once we have debited your card and sent you a confirmation booking reference which will be displayed on your screen and emailed to you.
  2. In the case of tickets being offered for sale at the wrong price on-line (i.e. at a higher or lower price than is applicable at the box office) we reserve the right to insist that the tickets are refunded and the correct prices charged.

  4. Tickets booked online will offer three methods of collection: Print at home (free), collection from QUAD Box Office (free) or Royal Mail Recorded Delivery (charged).
  5. Tickets purchased under a print at home agreement will be emailed to the email address provided at the time of sale and should be shown at the entrance to the event on a printed page or on a mobile phone, tablet or other device for scanning. Mobile signal is not guaranteed at any venue so tickets shown on a mobile device should be saved as a PDF or screenshot prior to arrival. Customers arriving without a valid copy of their ticket may be refused entry.
  6. Tickets selected for collection from QUAD should be collected at any time from when the booking is made until 48 hours before the event start time. You will need to bring either the card you paid with or a note of the booking reference to collect your tickets.
  7. Children’s tickets are offered for sale on the Website. In accordance with our General Terms you must bring proof of status or age with you to the cinema to collect the tickets and to gain admission to the event or screening.
  8. Children’s tickets must be selected at the time of purchasing to claim any discount. It is not possible to amend the booking once it has been completed.
